Your Financing Questions, Answered

Can I refinance an investment property with delinquent property taxes?

A request may be reviewed if the tax balance, title position and proposed payoff can be addressed within the transaction. Provide current tax statements and all known sale or enforcement deadlines.

Can financing pay off tax liens or judgments at closing?

That may be evaluated with the lender, title company and counsel. Required payoffs, releases and lien priority must be established before assuming the property can secure a new loan.

Can I get a real estate loan when an IRS lien is involved?

Disclose the lien and provide the relevant notices for a transaction-specific review. Counsel and the title company must assess what resolution is required; a new loan does not automatically remove a lien.

Can a private loan refinance a mortgage in foreclosure?

A request may be reviewed where value, payoff, time and the proposed exit support it. Do not assume that applying for financing pauses a scheduled sale or enforcement action.

Can I finance a discounted payoff with my existing lender?

A negotiated payoff may be considered if it is documented and the new financing is feasible. Any deadline, release requirement and condition of the agreement must be reviewed.

Can a real estate investor obtain financing during bankruptcy?

Bankruptcy-related financing requires specialized legal and capital review. PMAG can assess a submitted scenario, but availability and required authority must be established with bankruptcy counsel.

What is debtor-in-possession financing for real estate?

DIP financing refers to financing for a debtor operating in bankruptcy. The specific case, collateral and legal requirements determine whether a proposed structure can proceed.

Can financing help an investor exit bankruptcy?

A proposed creditor-payoff or exit transaction may be evaluated alongside the case requirements and repayment plan. It should be coordinated with counsel before any funding assumption is made.

Can an estate or executor borrow against real estate before a sale?

A request may be reviewed after counsel establishes ownership and the representative's borrowing authority. Estate administration status, property use, debt and the intended sale affect feasibility.

Can I finance an inherited-property purchase or an heir buyout?

A business-purpose request may be considered where ownership, authority and title requirements can be resolved. Submit the proposed transaction and have estate counsel clarify the approvals required.
